that the surrender to the Colonial Government of the land re-

-quired for the road would not under the conditions (1) and (11) proposed by Colonel Brown, and agreed to in my letter of the 19th. December, 1905, in any way impair the efficacy of the battery at North Point and the 2nd. paragraph of the Memorandum which, according to the earlier circular i have referred to,

was agreed upon by the War Office, the freasury and Colonial

Office, would seem to have scecial application to such surrender,

This paragraph is as follows:-

"The Military Authorities, acting on behalf of the Secretary of State (for war), should, therefore, in com- -munication with Colonial Governments, deal with Colonial

Military lands and buildings in such way as may best secure

(1). The efficient execution of the special

service to which the lands and buildings are devoted,

(2). The general interests of the Colony".

In the present case the efficient execution

of the special service to which the land at North Point is as-

-voted would not be affected by the surrender of the land re-

-quired for the improvement of the road at North Point while

this improvement would serve not only the general interests of

the Colony but also the special interests of the war Lepartment

in having the best possible communications within the line of

the defences.

In these circumstances I trust Your Excel-

-lency will now agree to recommend to the War Office the sur-

-render of the land in question when required for the construc-

-tion of the road subject to conditions (1) and (ii) proposed

by Colonel Brown and to a sum of $16,840 being credited to thr

War Department in the Military Lands Account.

Wailing this agreement I shall be force.
